California Employee, Applicant, and Independent Contractor Privacy Notice

Your submission of an application or your working relationship, whether it is as an employee (including full and part-time) or as a contractor (including intern, consultant, or other third party provider) for IZEA Worldwide, Inc. or one of its subsidiaries or affiliates (“IZEA”), is subject to this California Employee, Applicant, and Independent Contractor Privacy Notice (the “Notice”), in addition to any applicable agreements between you and IZEA.

The following details and describes the types of information we may gather from California residents who are applicants, employees, or contractors of IZEA, and how we use such information. We understand the importance of privacy and, accordingly, treat all information received in a responsible manner. This Notice applies to IZEA Worldwide, Inc. and its subsidiaries. By entering into or continuing your relationship with IZEA, you agree to be bound by the Notice. If you do not agree to the terms of this Notice, please do not enter into or continue such a relationship with IZEA.

I. Notice at the Point of Collection of Personal Information

IZEA may collect two types of information from California residents: “personal information” (which personally identifies a user such as name, e-mail address, mailing address, phone number, etc.) and “aggregate information” (which combines non-personal information). We use this information during the period of the relationship between yourself and IZEA.

IZEA may collect two types of information from California residents: “personal information” (such as name, e-mail address, mailing address, phone number, etc.) and “aggregate information”. We use this information to communicate with you, maintain business records, facilitate payments, and comply with applicable laws.

Categories of Sources

We obtain the categories of personal information listed herein from the following categories of sources:

  • Directly from our employees, customers, contractors, or their agents.
  • Indirectly from our employees, customers, contractors, or their agents
  • Directly and indirectly from activity on our websites (including submissions through our website portal, data collected from connected websites, or website usage details collected automatically).
  • From third-parties that interact with us in connection with the services we, or they, perform.

Collecting and Using Your Personal Information for Business Purposes

IZEA collects information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device (“personal information”). In particular, we have collected the following categories of personal information from consumers within the last twelve (12) months:

A name, signature, Social Security number, physical  characteristics or description, address, telephone number,  passport number, driver’s license or state identification card  number, insurance policy number, education, employment,  employment history, bank account number, credit card  number, debit card number, date of birth, or any other  financial information, medical information, or health  insurance information. Some personal information included in  this category may overlap with other categories. YES
C. Protected classification  characteristics under  California or federal law. Age (40 years or older), race, color, ancestry, national origin,  citizenship, religion or creed, marital status, medical  condition, physical or mental disability, sex (including gender,  gender identity, gender expression, pregnancy or childbirth  and related medical conditions), sexual orientation, veteran  or military status, genetic information (including familial  genetic information). D. Commercial information. Records of personal property, products or services  purchased, obtained, or considered, or other purchasing or  consuming histories or tendencies. NO
E. Biometric information. Genetic, physiological, behavioral, and biological  characteristics, or activity patterns used to extract a template  or other identifier or identifying information, such as,  fingerprints, faceprints, and voiceprints, iris or retina scans,  keystroke, gait, or other physical patterns, and sleep, health,  or exercise data. NO
F. Internet or other similar  network activity. Browsing history, search history, information on a  consumer’s interaction with a website, application, or  advertisement as accessed on a company device. YES
G. Geolocation data. Physical location or movements. NO
H. Sensory data. Audio, electronic, visual, thermal, olfactory, or similar  information. NO
I. Professional or  employment-related  information. Information related to current or past job history,  performance evaluations, references, and similar information. YES
J. Non-public education  information (per the Family Education records directly related to a student maintained by  an educational institution or party acting on its behalf, such YES
Educational Rights and  Privacy Act (20 U.S.C.  Section 1232g, 34 C.F.R.  Part 99)). as grades, transcripts, class lists, student schedules, student  identification codes, student financial information, or student  disciplinary records.
K. Inferences drawn from  other personal information. Profile reflecting a person’s preferences, characteristics,  psychological trends, predispositions, behavior, attitudes,  intelligence, abilities, and aptitudes. NO

Personal information does not include:

  • Publicly available information from government records.
  •  De-identified or aggregated consumer information.
  • Information excluded from the CCPA’s scope, like:
    • health or medical information covered by the Health Insurance Portability and
      Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical
      Information Act (CMIA) or clinical trial data;
    • personal information covered by certain sector-specific privacy laws, including the Fair
      Credit Reporting Act (FCRA), the Gramm-Leach-Bliley Act (GLBA) or California Financial
      Information Privacy Act (FIPA), and the Driver’s Privacy Protection Act of 1994.
  • As a California resident agreeing to this Notice, you consent to the access and collection of data and
    content provided to or gathered by IZEA during the term and scope of the relationship.

How IZEA Uses Your Personal Information

IZEA uses collected personal information for a valid business purpose, including communicating with
you, evaluating candidates and applicants, maintaining updated employee and contractor files,
delivering or processing payment, and complying with audit and legal requirements, including
responding to law enforcement or legal requests as required by applicable law, court order, or
governmental regulations. You may contact us regarding your email preferences.

IZEA Does Not Sell Your Personal Information

IZEA does not sell personal information to third parties, and has not sold any personal information in
the preceding twelve (12) months.

Sharing Your Personal Information

IZEA may disclose your personal information in the course and scope of your relationship with IZEA
to a third party pursuant to a business purpose. When IZEA discloses your personal information for a
business purpose, we enter a contract that describes the purpose and requires the recipient to both
keep that personal information confidential and not use it for any purpose except performing the
contract.
IZEA may share your personal information with third party service providers.

II. Changes to this Notice

IZEA reserves the right to amend or alter this Notice at our discretion and at any time. When we make
changes to this Notice, we will provide you with a copy of the updated notice and revise the Notice’s
effective date. Your continued relationship with IZEA following the provision of changes
constitutes your acceptance of such changes.
